#DengGate: PNOY VIOLATED SC DAP RULING ON SAME YEAR IT WAS ISSUED

The Supreme Court of the Philippines declared DAP unconstitutional in February 2015. In the decision, the SC said it is inter-departmental transfers of savings are illegal.

Ten months later, Pres. Noynoy Aquino took P3.5 billion from savings from the Miscellaneous Personnel Benefits Program, a retirement fund for government workers, and transferred it to the Philippine Children’s Medical Center, squarely violating the SC ruling on DAP.

PNoy actively looked for ways to rechannel savings, as evidenced by the minutes of the 1st Meeting of the Department of Health (Philippines)‘ Formulary Executive Council (FEC) on 07 Jan 2016.

According to the document, the Office of the President of the Philippines – Malacanang solicited proposals from the Secretaries of various government agencies for possible funding using savings from national agencies.

One of the “winning” proposals is the P3.5 billion procurement of Sanofi Pasteur‘s Dengvaxia, the defective anti-dengue vaccine that will be the subject of tomorrow’s Blue Ribbon #SenateHearing.

I guess PNoy wasn’t too worried about it. He appointed no less than Chief Justice Lourdes Sereno, after all.
